Department of Justice Enters Lawsuit to Stop California's Redistricting Plan
Federal authorities have officially joined a legal challenge brought forward by California Republicans, seeking to prevent the California's newly approved congressional redistricting map.
This legal action, submitted to federal court, targets the redistricting plan supported by the state's Democratic governor, which was developed in reaction against a Republican-led gerrymander in Texas.
"California's electoral map represents a brazen power grab that tramples on civil rights and mocks the democratic process," declared the US attorney general.
Democrats have expressed confidence that the redistricting plan will withstand court challenges.
"The plaintiffs were defeated in the election and they are likely to face defeat in the judicial system," stated a spokesperson for Governor Newsom.
Legal Basis
The lawsuit asserts that California's map improperly used race as a factor to heavily favor Latino communities in violation of the federal constitution.
"Race cannot be used as a proxy to advance political interests, but that is exactly what the California General Assembly did with Proposition 50," argued a senior official from the DOJ's civil rights unit.
Political Context
The legal battle constitutes the major response by the Democratic party in the ongoing redistricting war that started with Texas and has spread across multiple states.
In contrast to elsewhere, where Republican state legislatures have enacted gerrymanders, California's plan needed voter approval, which it obtained with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to gain just a small number of GOP-controlled House seats to gain majority of the House of Representatives in next year's midterm election.
The political group controlling the controlling share will shape the remaining period of the current administration, deciding if a unified Republican Congress will continue to deliver its political program or face resistance, investigations and possible additional obstacles.
